The charges stem from separate sexual assault allegations, one from 1994 and another from 2005, involving two men from Tsuut’ina Nation. The Edmonton Police Service (EPS) began investigating after the 1994 allegation surfaced in November 2024. The 2005 incident was uncovered in May 2025.

Whitney was arrested by Edmonton police on August 6, 2025. He has denied the charges, calling them false and without merit. He stated he would continue his duties as chief, committed to serving the Tsuut’ina people.

The Allegations

  • The 1994 incident involved the assault of a 33-year-old man in the 178 Street and 87 Avenue area of Edmonton.
  • The 2005 assault allegedly occurred when a 38-year-old man was assaulted in the Stony Plain Road and 178 Street area.

The Edmonton Police Service stated that the complainants were known to Whitney but not connected to each other. Investigators have expressed concern about the possibility of additional complainants and are urging anyone affected to come forward.

His lawyer, Jim Lutz, stated that Whitney has fully cooperated with the investigation. “These are devastating allegations,” Lutz said, adding that Whitney intends to defend himself vigorously against the charges.

Community Response and Investigation

The historical nature of the allegations has raised concern within the Tsuut’ina Nation and the wider community, especially due to Whitney’s leadership role. Detective Brian McGuigan from the EPS Sexual Assault Section acknowledged the significant impact of such allegations, particularly when they involve those in positions of authority.

EPS encourages anyone who believes Whitney victimized them to come forward. Authorities have stated that, for now, they do not expect to lay further criminal charges against him, though investigators are still working on the case.

Looking Ahead

Whitney remains the chief of Tsuut’ina Nation. While the charges represent a significant development, he has expressed his intention to continue leading the Nation. His leadership and ongoing responsibilities now face scrutiny as the legal process unfolds.
